1. Personal Data
The General Data Protection Regulation provides a comprehensive definition of the concept of personal data, being any information, regardless of its nature, capable of identifying a particular person by reference to an identifier, such as a name, an identification number, location data, an online identifier or to one or more specific factors of the physical, physiological, genetic, mental, economic, cultural or social identity.
From now on, said identifiable natural person will be named as the data subject.
2. Why does HELIOTEXTIL need to collect and store this data?
In cases where this applies, HELIOTEXTIL will use this type of data for the purposes of compliance with contracts in force between the parties and / or inherent and necessary to perform in the scope of providing a service.
We strive to make sure that the storage and processing of this information does not in any way constitute an invasion of your privacy. In relation to being contacted for marketing purposes, HELIOTEXTIL undertakes not to send any communications of this scope without first obtaining your consent.
3. Data retention period
The Data Retention period is governed by the need to fulfill financial or contractual obligations within the legal limits. In the case of marketing communications, this period is undefined, but may be interrupted, definitively or temporarily, in case of cancellation of subscription, or by explicit request to remove data from our database (in order to know how you can make this request, read point 6 and 7 of this document).
4. Will HELIOTEXTIL share my data with someone?
HELIOTEXTIL may transmit your personal data to the Tax Authority only by legal imposition. In any other case, your data will be safeguarded, with no data being shared for commercial purposes.
5. How will the personal data collected by HELIOTEXTIL be used?
HELIOTEXTIL processes this information in accordance with Regulation (EU) 2016/679 (General Regulation on Data Protection - RGPD) and the applicable data protection legislation, in all the activities of personal data treatment that are its responsibility.
In addition to the situations in which we treat data to comply with legal requirements, we treat your data for the following purposes:
Business transactions: Whenever you request your tax identification number in your purchases;
Online Sales: Your personal information is used to enable you to purchase articles from a distance and access your purchase history;
Marketing purposes: We will also need your contact information so we can send informational communications such as news, campaigns and discounts or benefits. You can at any time withdraw the indication to receive this type of communication.
6. Can I know which personal data HELIOTEXTIL keeps about me?
Whenever you want, you may ask HELIOTEXTIL to provide you with the information we hold about you, as well as its treatment and processing.
7. What are my data protection rights?
- Right of access of the data subject: As explained in point 6 of this document, the data subject has the right to obtain confirmation from the data controller if the personal data concerning him are treated or not, and, if they are, the right to access their personal data and other information, such as the purpose of the processing, the categories of personal data in question, the recipients to whom the data were or will be disclosed, the foreseen retention period, among others.
- Right of Rectification: The data subject has the right to obtain, without undue delay, from the controller, the rectification of inaccurate personal data concerning him. In view of the purpose of the processing, the data subject has the right to complete his incomplete personal data, including through an additional declaration.
- Right to Treatment Limitation: The data subject has the right to obtain from the controller the limitation of treatment, for example in situations where data is inaccurate, or where treatment is unlawful and the data subject opposes the deletion of the personal data.
- Direito ao Esquecimento: O titular tem o direito a que sejam retiradas todas as informações que o identifiquem pessoalmente, sem demora injustificada, de acordo com os motivos previstos no n.º 1 do artigo 17.
- Right to Erasure: The data subject has the right to have all personally identifiable information removed without undue delay in accordance with Article 17, number 1.
- Data Portability Right: The data subject has the right to receive the personal data that concerns him and which he has provided to a data controller in a structured, regular and automatic reading format, as well as the right to transmit such data to another controller without the previous data controller being able to prevent it, if the processing is based on consent or is performed by automated means.
- Right of Opposition: The data subject has the right to oppose, at any time, on grounds relating to his particular situation, the processing of personal data concerning him. Upon opposition, the data controller ceases the processing of personal data, unless he submits compelling and legitimate reasons for such processing that prevail over the interests, rights and freedoms of the data subject, or for the purposes of declaration, exercise or defense of a right in a court case.
- Right not to be subject to automated individual decisions: The data subject has the right not to be subject to any decision made solely on the basis of automated processing, including profiling, with consequences on the legal spectrum of the data subject, or significantly affecting him in a similar way.
As a rule, the data subject of personal data has the above mentioned data protection rights safeguarded.

If you believe that there is any breach of the General Data Protection Regulation on our part, you may preferably contact us first and explain the situation so that we can resolve it promptly. Nevertheless, you may submit a complaint directly to your National Data Protection Commission.
